Content Rules
These rules apply to everything you enter on moebia: prompts and corrections in the chat and the details in your profile (handle and display name). moebia is provided by Sascha Rahn, Lagerstr. 6b, 82178 Puchheim, Germany, email legal@moebia.io.
These rules explain and supplement section 8 of the moebia Terms of Service. The rights you grant moebia in your content, the rights you receive in the results, moebia's liability and what you are responsible for are set out in sections 7, 10 and 14 of the Terms of Service and not repeated here. If these rules and the Terms of Service conflict, the Terms of Service prevail.
1. Basic rule: only content you are allowed to use
Only enter content that you are allowed to use for the intended purpose: because it comes from you, because it is free to use, or because the rights holders have given you permission that covers exactly this use. This applies in particular to texts, names, brands and logos that are to appear in the loop.
The reason: moebia transmits your input to an AI system, which creates the loop from it. What you enter may appear in the result, for example as text in the animation, and you then use the loop on your website or in your channels. Whether a loop infringes the rights of third parties therefore also depends on your input.
2. Prompts, corrections and profile
- Only use other parties' brands, logos, product designs, characters or texts if you are allowed to, for example a client's brand on the client's behalf or a brand you hold a licence for. A loop on a business website is advertising; whether a third-party brand may appear in it depends on the individual case.
- Do not describe real, identifiable people, for example by name, appearance or voice, without their verifiable consent.
- An AI system creates the loop. Despite these rules, it may produce elements that resemble other parties' works, brands or characters. Check every version before you publish it, and report such cases to legal@moebia.io.
- Other signed-in users see the first prompt of a public loop and may copy it (section 7 (7) of the Terms of Service). Do not write names of clients, confidential details or personal data of third parties in it.
- For your handle and display name, do not choose names of other persons or companies, trademarks you are not allowed to use, or anything offensive or misleading.
3. Prohibited content and uses
The following are not allowed:
- content that infringes third-party rights, in particular copyright, related rights, trademark rights and personality rights;
- illegal content of any kind;
- input with which you try to get around technical checks, limits or blocks of the service, for example to make the AI system produce code that accesses other systems or harvests data.
4. What moebia does and does not do with your content
- moebia processes your input only to create your loops: transmitting it to the AI system, planning and coding each version, technical checks, rendering the poster and, at your request, the video, and providing them for download.
- moebia uses the internal plan that the AI system creates for each version only for the loop it belongs to.
- Versions and their files are available only to you after you sign in. A loop becomes public only if you have created a public profile: then other signed-in users see its preview video and preview poster with the logo, its title and its first prompt in Explore and on your profile page (section 3 (8) of the Terms of Service). moebia offers no sharing links. You decide where to use a result; you host the HTML embed on your own website.
- moebia does not use your input, plans or results to train AI models, for advertising or as references, unless you agree to this separately with moebia.
5. Reporting infringements
Anyone who believes that content on moebia infringes rights or is illegal can report it without an account using the report form at moebia.io/report (the "Report content" link in the footer of our public pages) or by email to legal@moebia.io, in German or English. Where moebia offers Explore, public loops and profiles can also be reported directly there and on the profile page via "Report". So that moebia can assess the report, it should include:
- an explanation of why the content is illegal or which right is infringed;
- details that are as precise as possible for finding the content: the address of the website where a loop can be seen, for a profile the address of the profile page, the file name of a video or poster, a loop ID or a description; private content on moebia has no public address;
- the name and email address of the person or organisation reporting;
- a statement that the information is accurate and complete to the best of their knowledge.
moebia confirms receipt, assesses the report carefully and communicates the outcome. Where an infringement is apparent, moebia blocks or removes the content without delay; a measure against a loop applies to all its versions. The user concerned receives a statement of reasons.
6. Consequences of violations
If these rules are violated, moebia may block or remove the loop concerned with all its versions, take a loop or a profile out of Explore, reset a handle, restrict individual features and, in serious or repeated cases, temporarily block the account or end the use contract. You will receive a statement of reasons that includes the ways to challenge the decision; what happens to paid credits and a running subscription is governed by the Terms of Service. Rights holders may also bring claims against you directly.
