moebia Terms of Service

1. Scope and contracting party

(1) These terms apply to the use of moebia at moebia.io ("the service") and to the purchase of subscriptions and credit packs. The service is intended exclusively for traders: natural and legal persons and partnerships with legal capacity that act in the course of their trade, business or profession when concluding the contract (section 14 of the German Civil Code, BGB), such as companies, agencies, freelancers and self-employed professionals. We do not conclude contracts with consumers (section 13 BGB).

(2) Confirmation as a trader. When you sign up, you confirm in a separate step that you use the service for your trade, business or profession. Before every purchase, whether a subscription or a pack, you enter the name of your business or self-employed activity and confirm again that you are buying as a trader. We record both confirmations with the time and the version of the text. If we learn that an account or a purchase is, contrary to these statements, attributable to a consumer, we may terminate the use contract; a running subscription then also ends, and we refund paid, unused credits under section 5 (8).

(3) The provider of the service and your contracting party for its use and for every purchase is:

Sascha Rahn, Lagerstr. 6b, 82178 Puchheim, Germany · Email: legal@moebia.io · Phone: +49 89 12258852 · VAT identification number: DE289645555

moebia is a product brand of Sascha Rahn. In these terms, "we" and "us" mean Sascha Rahn.

(4) Payments, including the recurring payments of a subscription, are handled by Sold through Link, LLC ("Link"), a company of the Stripe group, as merchant of record. Link is not the seller. Link acts in the name and on behalf of Sascha Rahn, but appears towards you in the checkout and on receipts in its own name. Link handles payment, the calculation and remittance of VAT and similar taxes, receipts and invoices, support for orders, subscriptions and payments, and refunds. Your contracts for subscriptions and packs are with Sascha Rahn; by paying Link you discharge your payment obligation towards us.

(5) The handling by Link is additionally governed by Link's customer terms (Sold Through Link Terms and Purchase Terms), available at https://link.com/terms. Rights that Link grants you there remain unaffected by these terms; nothing in these terms restricts them.

2. Conclusion of contracts

(1) Use contract. You need an account to use the service. When you sign up, you provide your name, your email address and a password and declare that you have read these terms and agree to them. Separately, you confirm that you are acting as a trader (section 1 (2)). We then send you an email with a confirmation link. The use contract is concluded when you confirm your email address via this link. The account and the starter credits under section 5 are free of charge.

(2) Buying a subscription or a pack. You buy subscriptions and credit packs in the signed-in area under "Billing", packs with or without a subscription. Before we forward you to the checkout, we show you the information on the subscription or pack and the price plus tax, for a subscription also the monthly renewal, for a pack the validity of its credits, and refer you to these terms. You enter the name of your business or self-employed activity and confirm that you are buying as a trader (section 1 (2)). In Link's checkout you enter your payment details; there you can review and correct your entries before submitting. By clicking the order button in the checkout you make a binding offer. The contract is concluded as soon as Link confirms the payment; we then credit the credits to your account, for a subscription the credits of the first billing period.

(3) Contract text and language. These terms are available at any time at moebia.io and can be saved and printed. We store which version you agreed to at sign-up and when we notified you of changes (section 17). Link sends you the receipts for your purchases and for the payments of your subscription by email. We conclude contracts in German or English; the German version prevails (section 20).

3. Services

(1) What the service does. You describe in a chat what your loop should show (prompt). An AI system plans an animation from it, writes its code and, after automated technical checks, creates a version of the loop. Every further message in the same chat (correction) creates a new version that builds on the latest finished version; earlier versions are kept. Which files a version includes depends on the credits its round was paid with (paragraph 7). An unlocked version consists of a loopable HTML embed and a preview image (poster, WebP); at your request, we create a video from it (MP4, H.264, 60 frames per second, without sound), at most one per version. You choose the aspect ratio in the chat, or the AI system sets it based on your prompt; the app shows the available aspect ratios (short side 1080 pixels). The AI system sets the duration based on your prompt.

(2) Internal plan. For each version, the AI system creates an internal plan of the animation. It serves only to build this version and to build later versions of the same loop on it. We do not show the plan and do not provide it for download; what we owe are the versions with their files.

(3) AI system. The plan and the code are created by an AI system based on a language model of a third-party provider (currently Claude by Anthropic). The AI system does not reply with text and does not ask questions; it may decline a message, for example if it asks for illegal, hateful or sexual content or for a deceptive depiction of real persons. Before delivery, the service automatically checks every version for technical points such as the seamless loop, the legibility of texts, and the size and safety of the generated code; in doing so, the AI system may revise the code based on the check results and on still images of the animation. No human reviews results before delivery.

(4) Characteristics of AI results. AI results have characteristics that may deviate from what you can usually expect from a digital product:

  • Results differ with every run and cannot be reproduced identically.
  • Design, motion, timing and texts may deviate in detail from your prompt or your correction; a correction may also change parts you did not want to change.
  • Results may contain errors, for example misspelled texts or overlapping elements, that the automated checks do not detect.
  • A particular design quality is not owed.
  • Results may coincidentally resemble designs of third parties; no check for third-party rights takes place.

These characteristics are part of the description of the service and determine the quality the service owes.

(5) Provision and storage. Versions and their files are available only to you after signing in; a loop becomes public only under paragraph 8. You host embeds yourself on your website; the embed codes in the service point to files that you store there. We keep loops with all their versions until you delete the loop or your account; individual versions cannot be deleted. We delete loops without a finished version 90 days after your last action in that loop. The service is not an archive: download the results you want to keep.

(6) Availability. The service may be temporarily unavailable due to maintenance, security measures or disruptions at our technical service providers. We announce planned maintenance in advance where possible. A round that is interrupted as a result uses no credits. Your statutory rights remain unaffected.

(7) Preview versions and unlocking. A round that you pay for with credits from your subscription, from a pack or with bonus credits (section 5 (10)) delivers an unlocked version under paragraph 1. A round that you pay for with starter credits (section 5 (4)) delivers a preview version. It consists of a preview video (MP4, H.264, short side 576 pixels, 30 frames per second, without sound) and a preview poster (WebP) of the same size; both visibly show the moebia logo in the bottom right corner. For a preview version, we do not provide the HTML embed, embed codes, poster or video under paragraph 1, nor its code. If a preview video cannot be created, you can have it created again in the chat without using credits. You can unlock a preview version at any time with credits from your subscription, from a pack or with bonus credits (section 5 (5)); starter credits do not unlock versions. Once unlocked, it is permanently an unlocked version. Each version is unlocked individually; later versions of the same loop again depend on the credits of their round. Versions against which we have taken a measure under section 9 cannot be unlocked. Unlocking with your first purchase: With your first purchase, meaning the first paid billing period of a subscription or the first pack, we unlock up to three of your finished preview versions without credits, the most recent first. A round that reserved starter credits before the purchase and is finished only afterwards is also unlocked without credits, as long as the three unlocks have not been used up. If the purchase is refunded later, these unlocks remain.

(8) Explore and public profile. Where the service offers these functions, the following applies: In Explore, we show signed-in users example loops by moebia ("Demos"), public loops of other users ("New") and their own favourites ("Favorites"). Your loops become public only once you create a public profile (section 4 (4)); every loop you create after that then appears in Explore and on your profile page, unless you hide it under paragraph 9. Loops you created before creating the profile remain private. For a public loop, we show the preview video and the preview poster of its latest finished version with the moebia logo (paragraph 7), also for an unlocked version, as well as its title and the prompt of its first message (original prompt, section 7 (7)). Others do not see corrections, earlier versions, the HTML embed, the poster or the video. Explore and profile pages are visible only after signing in. With a heart you mark a loop as a favourite; only you see your favourites, and we do not show who marked a loop. If you delete a loop, it disappears from Explore, from your profile page and from other users' favourites. You are not entitled to a loop appearing in Explore or in a particular position.

(9) Hiding from Explore. With a Pro or Studio subscription, you can, where the service offers it, set in your profile that your loops do not become public. The decisive factor is the subscription tier of the current billing period. Whether a loop is public or hidden is set when the loop is created; later corrections do not change this. When you switch on hiding, you can also hide your existing public loops at the same time. If you switch to Starter or your subscription ends, hidden loops stay hidden; loops you create after that are public again as long as you have a profile.

4. Account

(1) Provide truthful information when you sign up and keep your email address up to date. Keep your password secret. If you notice that someone is using your account without authorisation, please inform us without delay.

(2) Your account is personal and cannot be transferred.

(3) If we block your account or individual functions under section 9, your credits remain; no credits are forfeited because of the block. A running subscription continues. Credits with a period of validity, meaning the credits of a billing period, credits from packs and bonus credits, expire under section 5 at the end of their period even if you cannot use them during the block. You can cancel the subscription at any time, also during a block (section 15 (2)).

(4) Profile and handle. A public profile is optional and free of charge. You create it with a handle and a display name of your choice; we do not show the name of your account. A handle consists of 3 to 30 lowercase letters, digits or underscores and is unique; we do not assign certain handles, for example those that could be confused with moebia or with areas of the service. You can change your handle at most once every 30 days; a previous handle does not redirect to your profile and may then be chosen by others. For your handle and display name, do not choose names of other persons or companies, trademarks you are not allowed to use, or anything offensive or misleading (section 8). If a handle violates this, we may reset it under section 9. We delete your profile with your account or at your request to legal@moebia.io; your loops are then no longer public.

5. Credits, subscription and prices

(1) Subscription. A subscription includes a quota of credits for each monthly billing period. These tiers are available:

SubscriptionCredits per monthPrice per month plus tax
Starter600€29
Pro1,800€79
Studio5,000€199

One subscription can run per account. With Pro and Studio, you can hide your loops from Explore (section 3 (9)).

(2) Credit packs. You can buy additional credits in one-time packs, with or without a subscription:

PackCreditsPrice plus tax
300 credits300€19
1,000 credits1,000€59

(3) Prices. All prices are in euros plus VAT or a similar tax, such as GST or sales tax, where it applies. Link calculates the tax in the checkout based on your billing address and shows it on the receipt. If the checkout shows the amount in another currency, Link converts it; the contract price remains the price in euros plus tax.

(4) Starter credits. Every account receives 300 starter credits on sign-up. They are free of charge and kept separate from paid credits. Starter credits are not paid out or refunded. A round paid for with starter credits delivers a preview version (section 3 (7)). In the app, starter credits are called "free credits". Starter credits you have not used by your first purchase expire when the credits of that purchase are added, meaning the first paid billing period of a subscription or the first pack, even if the payment is refunded later. If a round reserved starter credits before then, it uses them and delivers a preview version. Bonus credits do not end starter credits. You do not receive further starter credits.

(5) Use and prices in credits. Every message in the chat starts a round that creates a new version. The app shows how many credits a round, unlocking a preview version and other functions cost; you see the price of a round before you send. Currently, a round costs 100 credits and unlocking a preview version costs 100 credits; the video of an unlocked version and the preview video cost no credits. We may offer new functions with their own price in credits at any time, and we may lower prices in credits at any time; if we raise the price of an existing function, this is a change under section 17 (2). You pay for unlocking with credits from your subscription, from a pack or with bonus credits; they are used when you unlock. When you send a message, we reserve the price of the round; the credits are only used once the version is finished. If a round fails, the AI system declines the message, you stop the round or it exceeds its time limit, we release the reservation; the round costs nothing. A new attempt ("Try again") reserves the price again. You can see your available and reserved credits and the history of all bookings in your account.

(6) Validity and order. The credits of a billing period are valid for that period. They remain usable until the credits of the following period of the same subscription have been credited, at the latest until 24 hours after the end of the period; after that, unused credits of the period expire without being carried over. Credits from a pack are valid for 24 months from the purchase, with or without a subscription; after that, unused credits of the pack expire. Paragraph 4 applies to starter credits, paragraph 10 to bonus credits. We use paid credits and bonus credits first, starting with those whose validity ends earliest; we use starter credits last. Because starter credits expire with your first purchase (paragraph 4), you then always pay for a round with paid credits or bonus credits and receive an unlocked version. Credits are tied to your account.

(7) Payment. You pay in Link's checkout using one of the payment methods offered there. For a subscription, Link collects the price at the start of each billing period from the payment method on file; we credit the credits of a period as soon as its payment has been received. You manage your payment method and your receipts at Link. Link calculates any tax that applies and issues the receipt and invoice to you. Please address questions about the service to us; you can also address questions about payment, receipts and refunds to Link support (https://support.link.com). Under Link's terms, you can submit refund requests for a payment to Link support within 60 days of the payment.

(8) Refund when the contract ends. If you delete your account or the use contract ends for another reason, we refund paid credits that have neither been used nor expired, on a pro rata basis by the amount paid: per credit the amount you paid for the pack or for the current billing period of your subscription, divided by its number of credits. If a purchase has already been partly refunded, we split the amount not yet refunded over the remaining credits of that purchase. We do not refund starter credits or bonus credits. We initiate the refund within 14 days after your account is deleted, via Link to the original payment method; if that is no longer possible, we refund by another method agreed with you. If the use contract ends without you deleting your account, we delete it afterwards, 30 days after a termination for a violation. If you delete your account yourself, the deletion dialog shows you the credits and the way of the refund beforehand.

(9) Refund of a payment. If a pack purchase or the payment for a billing period is refunded in whole or in part, we remove a share of the credits of that purchase or period corresponding to the refunded amount, at most the credits that have neither been used nor expired. If you received a welcome bonus with the first billing period of your subscription (paragraph 10) and the payment for that period is refunded, we remove the same share of these bonus credits, all of them for a full refund, at most the unused ones. Unlocks with your first purchase (section 3 (7)) remain.

(10) Bonus credits and promotions. We add bonus credits to your account free of charge, for example as a welcome bonus with your first subscription, as part of a promotion or as a goodwill gesture. What a promotion includes, whom it applies to, until when it runs and how long its bonus credits are valid, we state with the offer. Bonus credits are valid for the period stated there, at most 90 days from when they are added; after that, unused bonus credits expire. A round paid for with bonus credits delivers an unlocked version, and you can unlock preview versions with bonus credits (section 3 (7)). Bonus credits are not paid out or refunded. In the app, they are called "bonus credits". We may change or end promotions for the future; bonus credits already added keep their period of validity. If a personal deadline has already started for you, such as the one for the welcome bonus, we will not change the promotion to your disadvantage until that deadline ends. You are entitled to bonus credits only if you meet the conditions stated with the offer.

6. No right of withdrawal

As we conclude contracts only with traders, there is no statutory right of withdrawal.

7. Your content: prompts and corrections

(1) Your content remains yours. Your prompts and corrections ("your content") remain your content. We acquire only the rights under paragraph 3.

(2) Your assurance. You only enter content that you are allowed to use for the service, including the display of public loops (paragraph 7), and for your planned use of the result. This applies in particular to third-party texts, brands, logos, characters and real persons (section 8).

(3) Your licence to us. You grant us a non-exclusive, non-transferable right of use in your content, limited to the purpose of providing the service to you and lasting until the content is deleted. It covers only these types of use:

  • storing, including technical backup copies;
  • transmitting it to the AI system and processing it there;
  • using it as the basis for further versions of the same loop;
  • rendering into the formats offered (HTML embed, poster, MP4, preview video and preview poster with logo);
  • providing the results for download exclusively to you;
  • for public loops, displaying the preview video, preview poster, title and original prompt to other signed-in users in Explore, on your profile page and in their favourites (section 3 (8));
  • processing in isolated computing environments (sandboxes) and on servers of our technical service providers, who act on our behalf and receive no rights of their own;
  • deleting.

(4) Tool acting on your behalf. Insofar as you cannot grant us a right under paragraph 3 yourself, you instruct us to carry out the acts as a technical tool on your behalf and within the scope of your own entitlement.

(5) No further use. We do not use your content, the internal plans or your results to train AI models, for advertising, as a reference or for any purpose other than the service; we show public loops only within the service under section 3 (8). We use an internal plan only for the loop it belongs to. Under its terms, the provider of the language model does not use the inputs and outputs for training either. Any exception would require a separate agreement with you.

(6) Indemnification. If a third party makes a claim against us for an infringement that is based on your content or on your use of the results and for which you are responsible, you indemnify us against this claim and reimburse us for the reasonable costs of legal defence in the amount of the statutory court and attorney fees. We inform you of the claim without delay and give you the opportunity to comment. Without fault on your part, you owe no indemnification. This provision does not change the statutory allocation of the burden of proof.

(7) Original prompts of public loops. Other signed-in users can see and copy the original prompt of a public loop. Insofar as it is protected, you grant every other user of the service the non-exclusive right, free of charge and unlimited in territory and time, to copy it and to use it, also in modified form, for their own prompts. For prompts that others have already copied, this right continues even if you later delete or hide the loop. Therefore, do not write anything in the first prompt of a loop that becomes public that others should not read or use, such as names of clients, confidential details or personal data of third parties.

8. Content rules

(1) Prompts, corrections and profile details (handle and display name) are not permitted if they

  • are illegal or call for illegal acts;
  • concern content for which you lack the necessary rights (section 7 (2));
  • use third-party trademarks, logos, characters, designs or texts without the permission of the rights holders;
  • are meant to depict or imitate real, identifiable persons without their demonstrable consent;
  • infringe personality rights or other rights of third parties.

(2) It is also not permitted to circumvent technical checks or blocks of the service or to use the service in an automated way to an extent that impairs its operation.

(3) The Content Rules at moebia.io/content-rules explain these rules with examples.

9. Moderation, notices and complaints

(1) How we detect violations. We learn of possible violations of section 8 mainly through notices. Anyone can report content they consider illegal, without an account, via the report form at moebia.io/report (the "Report content" link in the footer of our public pages) or by email to legal@moebia.io. Where the service offers Explore, signed-in users can also report public loops and profiles directly there and on the profile page via "Report"; the report form then takes over which loop or profile it concerns. The notice should explain why the content is illegal and identify it as precisely as possible, for example with the address of the website where a loop can be seen, the address of a profile page, the file name of a video or poster, or a loop ID. It should also state the name and email address of the person submitting it and confirm that the information is accurate and complete to the best of their knowledge. In addition, we carry out our own checks in individual cases, for example when there are indications of misuse. For measures under paragraph 2, we use automated tools only for technical checks, such as the safety of the generated code; they do not assess the content. A human decides on measures. Independently of this, the AI system may decline a message (section 3 (3)); this is not a measure under paragraph 2: the message stays in your chat, and the reserved credits are released.

(2) Possible measures. In the event of a violation, we may block or remove individual content, take a loop or your profile out of Explore and off your profile page, reset your handle, restrict individual functions, temporarily block your account or end the use contract under section 15. A measure against a loop applies to all its versions. We choose the mildest measure that suffices, taking into account your rights and interests and those of the persons affected. Section 4 (3) applies to your credits and a running subscription; if we end the use contract, the subscription ends too.

(3) Statement of reasons. We inform you of every measure by email at the latest when it takes effect and state our reasons: the type, scope and duration of the measure, the underlying facts, whether it is based on a notice, whether automated means were involved, the legal ground or the rule of these terms that was violated, the consequences for a running subscription, and your options to challenge it.

(4) Complaint. If you consider a measure or our decision on your notice to be wrong, you can object by email to legal@moebia.io. A human reviews the decision again and informs you of the result with reasons. You may also go to court at any time.

(5) Points of contact. The single point of contact for users and for authorities is legal@moebia.io. You can communicate with us in German and in English. Your message is answered by a human, not exclusively by an automated system.

(6) Criminal offences. If we become aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, we inform the competent authorities.

10. Rights in the results

(1) No promise of protection. Whether copyright or another protective right arises in an AI result, and who holds it, has not been conclusively settled in law; without a formative human contribution, copyright generally does not arise. We do not promise that results are protected.

(2) Your permission to use. Insofar as rights in a result arise for us or are held by us, including any related rights, we grant you a non-exclusive right of use, unlimited in territory and time, for all your purposes, including business purposes, in particular on your websites and in your channels. Independently of this, we permit this use by contract and waive any claims of our own against it. If you create results for your clients, for example as an agency or freelancer, you may pass them on to them, and your clients may use them to the same extent. This also applies after the use contract ends.

(3) Components by us. Paragraph 2 applies accordingly to components we created ourselves that are contained in results, such as the code of the embed and the playback logic.

(4) No exclusivity. The service may create similar results for other users. If results are not protected, third parties may adopt them; we cannot provide you with protection against this.

(5) Third-party components. We grant no rights in third-party components. Every HTML embed contains subsets of the typefaces it uses, from a fixed selection of typefaces licensed under the SIL Open Font License 1.1 (currently Geist, Inter, Space Grotesk, Fraunces, Newsreader, JetBrains Mono, Bricolage Grotesque and Nunito). This licence applies to these typefaces, and the licence notice in the source code of the embed must be kept.

(6) Preview versions. For a preview version, paragraphs 2 and 3 apply to the preview video and the preview poster in the form in which we provide them; you may therefore also use them for business purposes and pass them on. You may not remove, cover, obscure or crop out the logo in them. Usual technical processing, such as scaling, compressing or converting the format, is permitted as long as the logo remains recognisable. Once the version is unlocked, paragraphs 2 and 3 apply to all its files.

(7) Loops of other users. You receive no rights in public loops of other users other than viewing them within the service and using their original prompt under section 7 (7). We do not offer downloads for them. You may not download, record or retrieve in an automated way their preview videos and preview posters or use them outside the service, even if no protective right exists in them.

11. AI generation and marking

(1) The results are created with an AI system. We also point this out in the service directly at the input field, before you send a message.

(2) Videos and posters, including preview videos and preview posters, carry machine-readable markings that identify them as AI-generated: signed provenance information in the metadata and an imperceptible watermark. The HTML embed contains a note on its origin in its source code. The visible logo of a preview version is not such a marking; section 10 (6) applies to the logo.

(3) You may not remove, obscure or falsify the markings in videos and posters. Usual technical processing, such as compressing, scaling or converting the format, is permitted as long as it does not deliberately remove the marking.

(4) Anyone can check at moebia.io/check-file, free of charge and without an account, whether a file carries a moebia mark and how it was detected. The check runs in the browser; the file is not transferred to us. The help text at moebia.io/ai-generated-loops explains how to reuse AI-generated loops.

(5) If you use results professionally and create content with them that resembles real persons, objects, places or events and could falsely appear authentic (deep fakes), you must disclose yourself that the content is artificially generated.

12. Changes to the service

(1) Beyond what is necessary to maintain conformity with the contract, we change the service only for a valid reason. Valid reasons are in particular:

  • the provider of an AI model we use changes, replaces or discontinues the model;
  • new legal or regulatory requirements or court decisions;
  • reasons of security or the prevention of misuse;
  • a technical service provider changes or ends its service;
  • technical development, such as new formats or better methods.

(2) A change does not cause you any additional costs. We inform you clearly and comprehensibly about the change.

(3) If a change impairs your access to the service or its usability more than insignificantly, we inform you by email in good time beforehand about the content and timing of the change and about your rights. You can then end the contract free of charge within 30 days of the information or, if the change takes place later, of the change; a running subscription then also ends, and we refund paid, unused credits under section 5 (8). This right does not exist if you can continue to use the service unchanged without additional costs.

13. Warranty

(1) The statutory rights in the event of defects apply.

(2) If a finished version is defective, for example because files are missing or cannot be played, please contact us. As cure, we usually create the version again without using further credits. Section 14 applies to damages.

14. Liability

(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under product liability law.

(2) In the case of simple negligence, we are liable only for the breach of essential contractual obligations (so-called cardinal obligations). These are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely; at moebia in particular, to provide the service for creating loops, to credit and redeem the credits of your subscription and of purchased packs, to keep the files of finished versions available for download to the extent set out in section 3 (7) and not to use or disclose your content without authorisation. In this case, our liability is limited to the damage that was foreseeable at the time the contract was concluded and is typical for such a contract.

(3) Otherwise, we are not liable for simple negligence.

(4) These rules also apply to our legal representatives and vicarious agents.

15. Term, termination and account deletion

(1) The use contract runs for an indefinite period. A subscription runs for one month at a time and renews for a further month unless you cancel it. Buying a pack is a one-time purchase and does not renew.

(2) Cancelling and changing the subscription. You can cancel your subscription at any time to the end of the current billing period, in the app under "Billing" or at Link; if your account is blocked, at Link. Until then, you continue to use the subscription and its credits and can withdraw the cancellation in the app. You arrange a change of subscription tier in the app; it applies from the next billing period, without partial charges. Link may also end a subscription without our involvement, for example if you request the deletion of your account or your data at Link or if a check against sanctions lists is not completed; credits already added then remain usable under section 5 (6).

(3) Failed payment. If the payment for a new billing period fails, it is retried under Link's rules; you update your payment method at Link. We credit the credits of that period only once its payment has been received. If the payment finally fails, the subscription ends. Credits already added remain usable unless they have expired under section 5; we do not block your account for this reason.

(4) You can end the use contract at any time without notice by deleting your account yourself in the account settings or by asking us to do so by email to legal@moebia.io. Unused credits do not postpone the termination. A running subscription ends immediately with the deletion; after that, we charge nothing more.

(5) Before the deletion, you can download your results and request an archive of your data in the account settings (section 16). We refund paid, unused credits under section 5 (8). We point out both in the deletion dialog.

(6) With the deletion, we remove your account, your profile, your loops with all messages, versions, files and internal plans, your favourites and your data archives. We also delete your credit history, including purchase and refund bookings; your orders and the payments of your subscription stay with Link under its own retention periods. We keep some information in pseudonymised form, mainly as evidence: your acceptance of these terms and your confirmation as a business at sign-up, and the sending of our notices of changes to these terms (section 17), until the end of the third year after the year of deletion; your confirmation as a business at checkout, with the name of your business, until the end of the fourth year after the year of purchase, for a purchase from 16 December onwards until the end of the fifth year. In addition, there is a deletion receipt without name, email address or user ID, kept for three years from the end of the year of deletion. Details, including on records under the Digital Services Act and the order to cancel a subscription, are set out in the privacy policy.

(7) We may end the use contract

  • if we discontinue the service as a whole, with reasonable notice that we communicate to you by email; until the end of the notice period you can download your results;
  • without notice for good cause, in particular in the event of serious violations of section 8 or violations repeated despite a warning, or if we are legally obliged to do so; section 9 (3) applies.

In both cases, a running subscription ends with the termination, and we refund paid, unused credits under section 5 (8). Claims we have against you because of a violation remain unaffected.

16. Export and switching

(1) You can download the files of every finished version at any time: for an unlocked version the HTML embed, the poster and, once created, the video; for a preview version the preview video and the preview poster (section 3 (7)).

(2) You can request an archive of your data in the account settings at any time: account data with your sessions, your profile, your loops with messages, versions and their files (for preview versions the preview video and preview poster), your favourites, the status of your subscription, credit history and your confirmations, in common, machine-readable formats. The internal plans are not part of the archive (section 3 (2)). We provide the HTML embed, poster and video of a preview version only once it is unlocked. We email you when it is ready; you can then download it for 7 days. You can request one archive every 24 hours, free of charge. You can obtain access to data the archive does not contain, such as the internal plans or files of content we restricted under section 9, on request to legal@moebia.io within one month; details are set out in the privacy policy. Request the archive before you delete your account; after the deletion, the data no longer exists.

(3) We charge no fees for switching to another provider or to your own IT environment, or for exporting your data, including no fees for downloading it.

(4) Switching under the Data Act. You can request at any time that we transfer your exportable data (paragraph 5) to another provider or to your own IT environment, or that we erase it. No notice period applies. Send your request informally by email to legal@moebia.io. For a switch, the following applies:

  • Transition period. A transition period of 30 calendar days starts when we receive your request. During this period, we continue to provide the service unchanged, and you can download all exportable data under paragraphs 1 and 2, also more than once. We answer your questions about the switch and your exit strategy by email and point out risks known to us for an uninterrupted transition. You can extend the transition period once by a period you consider appropriate. If, by exception, a switch is technically not possible within 30 calendar days, we tell you so with reasons within 14 working days of your request and name a transition period of at most seven months.
  • End of the contract. The user contract ends as soon as you tell us that the switch is complete, at the latest at the end of the transition period; if you only request erasure, it ends when we receive your request. We confirm the end by email. A running subscription ends with the contract; we refund paid, unused credits under section 5 (8).
  • Retrieval period and erasure. After a switch, you can still download your exportable data for 30 calendar days after the end of the contract. After that, we delete your account with all exportable data completely under section 15 (6). If you only request erasure, we delete it right away. You can also delete your account yourself earlier at any time (section 15 (4)).

(5) Exportable data and formats. The exportable data are, exhaustively: your account data with your sessions, your profile, your loops with all messages (prompts and corrections) and versions, the files of the versions (HTML embed as HTML, poster and preview poster as WebP, video and preview video as MP4), your favourites, the status of your subscription, your credit history, your redeemed promo codes, your confirmations and our notices of changes to these terms. The archive under paragraph 2 is a ZIP file; the data are in JSON, the files in their formats, and a README file describes the structure and fields. Known limitations: for preview versions, only the preview video and the preview poster are exportable (section 3 (7)); files of content subject to a measure under section 9 are not exportable while the measure applies; a loop cannot be refined in a chat at another provider, but the HTML embed runs without the service. Exhaustively excluded from the export are the internal plans (section 3 (2)) and the intermediate states of a round, namely drafts of the code and the results of the automatic checks. They would reveal our methods and are trade secrets; this does not hinder a switch, because every finished version can be exported with its files.

(6) Location and protection against access from third countries. We run execution, the database and the files of your loops in data centres in Frankfurt am Main (Germany). Some of our service providers have their registered office in the USA and also process data there; the AI system stores requests in the USA. Details are set out in sections 13 and 14 of the privacy policy. We protect your data against unlawful access by public authorities of third countries to non-personal data as follows: we transfer it only in encrypted form, give service providers only what they need for their task (for example, no account data to the AI system), and hand over data to authorities of a third country only where an international agreement, such as a mutual legal assistance treaty, provides for it or Union law permits it.

17. Changes to these terms

(1) Editorial changes that do not affect your rights and obligations, such as correcting typing errors or a new address, we publish as a new version and point them out to you.

(2) Other changes we make only for an objective reason, in particular if

  • laws, requirements of authorities or case law change;
  • we introduce, change or discontinue functions of the service (section 12);
  • the costs or terms of service providers we use for the service change, for example for AI models, hosting or payment processing;
  • reasons of security or the prevention of abuse require it;
  • a provision is unclear or incomplete.

This also applies to prices and the scope of the services. A new price or a new number of credits of a subscription applies only from the first billing period that begins after the effective date; a new pack price only to purchases from that date; a higher price of a function in credits (section 5 (5)) only to rounds and unlocks you start from that date. Credits added to your account before keep their number and their validity.

(3) Notice. We notify you of a change under paragraph 2 at least 15 days before its effective date by email to the address of your account, in English, the language of the service. The notice states the content of and reason for the change and the effective date and refers to the new version, which we make available at moebia.io at the same time.

(4) Objection. You can object to the change until its effective date, informally by email to legal@moebia.io, including by replying to the notice. If you do not object, the change is deemed agreed from that date. We point out this consequence expressly in the notice.

(5) Consequences of an objection. If you object, the previous version continues to apply to you. We may then end the use contract with effect from the effective date at the earliest; a running subscription then also ends, and we refund paid, unused credits under section 5 (8). Your right to cancel a subscription under section 15 (2) and to end the use contract at any time under section 15 (4) remains unaffected.

(6) Sign-up during the notice period. If you sign up after we have announced a change but before its effective date, we point out the announced version to you at sign-up and also send you the notice under paragraph 3. Paragraphs 4 and 5 apply accordingly.

18. Data protection

How we process personal data is explained in our privacy policy. It is not part of these terms; by accepting these terms you do not consent to any data processing.

19. Dispute resolution

Please address concerns and complaints directly to legal@moebia.io.

20. Applicable law and language

(1) The law of the Federal Republic of Germany applies.

(2) These terms and the content rules are available in German and in English. In each case the German version prevails; the English version is a translation.
